Issue

(1) Occupational therapist (OT) was not invited to IEP meeting despite providing an evaluation and still being a service provider under stay-put regulations;

(2) District did not complete all the assessments listed on the Evaluation Consent Form;

(3) District did not respond to parent request for an IEE until request was in writing;

(4) District found ineligibility for special education services at meeting without reviewing whether student has a disability, is making effective progress, and needs specially designed instruction/services

(2) Disputed evaluation was noted as not needed at the meeting and the evaluations used were valid and reliable;

(3) Parent unable to show that request for IEE happened at Team meeting and district responded appropriately once written request was received; (4) Disputed meeting was ended early without a finding of eligibility but district has submitted required information for addressing ineligibility determination
