Issue

(1) District failed to “have a formal conversation” re: an IEP assessment;

(2) 504 accommodation plan for student is ineffective

Finding

Noncompliance:

(1) District did not seek consent and conduct evaluations prior to IEP meeting, despite acknowledgement that student required specifically designed instruction

Compliance:

(2) 504 plan meets legal requirements-District submitted documentation showing that all relevant staff were aware of 504 services and that meetings were held to make changes to assist student in making effective progress.It was determined that student required specifically designed instruction.

Corrective Action

District must hold training review for staff re: procedures following a request for a special education initial evaluation; procedures when parent requests meeting to review IEP or 504 plan progress; progress meetings, procedures for monitoring and tracking compliance on these issues

District must provide notice and evaluation consent form to parents and provide DESE. with copies and assurance to follow procedures
