District was not providing 1:1 nurse required in IEP

Finding

Noncompliance:

Student Remote Learning Plan did not include a 1:1 nurse and resulted in denial of FAPE, student cannot access curriculum without nurse

Corrective Action

District immediately update Remote Learning Plan with 1:1 nurse and submit the plan to DESE.

District must submit nurse’s start date, but may adjust the nurse’s extent of availability to the student due to COVID-19.
