IEP MEETING

Issue

(1) District failed to complete a transition assessment for student and thus, student’s IEP was not reasonably calculated to provide a free and appropriate education (FAPE).

(2) District failed to invite student to “discuss and to participate in the team meeting process to develop an IEP.”

 

Finding

Noncompliance:

(2) District did not comply because it failed to invite the student to his IEP meeting to consider measurable post-secondary goals and transition services.

Compliance:

(1) District complied with requirements for completing a transitional assessment because the assessments that district conducted were sufficient to determine student’s transitional needs and thus, may constitute a “transitional assessment.”

Corrective Action

District must invite student and convene the Team to consider student’s transition services and post-secondary goals (send DESE evidence of meeting and outcome by 10/1).

District must review its current procedures and process for tracking students who turn 14 to ensure IEP Teams invite students to Team meetings and complete transition requirements. District must indicate any changes made in procedure to ensure staff implementation of transitional responsibilities, inform appropriate staff of procedures, and send PRS evidence of review by 10/1.
