Issue

1) District failed to implement student’s IEP.

*DESE did not investigate claims that occurred over a year prior to filing this complaint. Also, DESE did not investigate parent’s rejection of the placement as it may be addressed through the Team or a BSEA hearing/mediation.

Finding

Noncompliance:

District has not complied with regulatory requirements as it did not have student’s Special Education Learning Plan (SELP), a student record, and was unable to provide it for the purposes of DESE’s investigation.

Compliance:

District implemented the last agreed upon IEP and placement. Parent’s view that student requires less restrictive placement was not addressed by PRS.

Corrective Action

District must review policy and procedures for maintaining student records with appropriate staff and provide evidence of this review with DESE by 12/15.
