Issue

(1) District failed to timely provide a proposed IEP following a Team meeting within required timelines.

(2) District failed to timely file the partially rejected IEP with BSEA.

Finding

Noncompliance:

(1) District acknowledged it did not comply with timelines for issuing a proposed IEP following a Team Meeting.

(2) District acknowledged it did not file the rejected IEP with BSEA in the required timeframe and already sent memorandum to staff.

Corrective Action

(1) No further corrective action necessary. DESE accepts District’s corrective action of distributing a memo to the COSE Coordinator and holding a discussion about timelines.

(2) By 9/15, District must submit to DESE a copy of the rejection notice filed with BSEA for the partial rejection of the IEP as well as the names/roles of people responsible for timely tracking of IEP rejections and filings to BSEA.
