Issue

(1) District failed to hold the Annual Review IEP Team meeting for SY19-20.

(2) District failed to provide all the requested student records, including complete progress reports and student data sheets (data collection sheets used by BCBAs and teachers to track behavior-based objectives and goals).

(3) District failed to implement the 30-minutes monthly parent conference for SY20-21.

* In a follow up conversation with the parent on 9/15/21, it was determined that the student was in the hospital for an extended period of time and the IEP expired. The Team met. District acknowledged noncompliance regarding the delay. Complainant advocate would like District to take ownership of procedural errors (send the required 2 copies of IEP instead of 1). A new administrator has been appointed to this student and progress reports are now being generated for student.

Finding

Noncompliance:

(1) District acknowledges noncompliance as they did not timely hold the Annual IEP Team meeting during SY19-20.

(3) District failed to implement the 30-minute monthly parent consultation as required under the IEP.

Compliance:

(2) District was found in compliance because the requested data collection sheets were not part of the student records and were not released to authorized school personnel but were considered personal memory aides of teachers/providers for analyzing student progress.

Corrective Action

By 10/5, District must send DESE a copy of the Notice of Proposed School District Action (N1), Meeting Invitation (N3), Attendance Sheet (N3A), and proposed/consented to IEP from the Annual Review IEP Team meeting held in June 2021.

District will review the IEP with staff for the implementation of parent consultation services and provide DESE names of those staff members by 10/5.

District will submit to DESE the information of person(s) responsible for oversight to track timely IEP Team meetings, provision of IEPs to parents, along with student progress reports, and the person responsible for this particular student by 10/5.
