Issue

(1) District failed to timely enroll Student despite being a resident of Brookline at the beginning of SY20-21.

(2) District failed to correctly determine transfer of rights at age of majority for Student because Student was noted as the sole decision maker instead of sharing decision making with the parent.

(3) District failed to implement Student’s IEP during SY20-21 because he was not provided with special education services upon enrollment and not until an IEP Team meeting was held and an updated IEP proposed.

 

Finding

Noncompliance:

(1) District delayed approximately 8 school days from confirmation of enrollment to when Student began attending school. District corrected its noncompliance by enrolling student and beginning student’s attendance virtually.

(3) District acknowledged noncompliance as it did not implement the IEP as received upon Student’s enrollment. District implemented corrective action by issuing a memorandum to District evaluation team facilitators and special education administrators regarding students who move into the district. DESE requires further corrective action.

(2) District complied by ensuring that Student completed the age of majority paperwork stating that Student wished to share decision making authority.

Corrective Action

District must issue a memorandum by 10/20 to district staff (evaluation team facilitators & special education administrators) and DESE addressing requirements to provide special education services comparable to those in students’ IEPs in their former district until the new district can determine whether they accept the finding of eligibility and/or the IEP. The district shall provide notice to parents if a new evaluation is necessary to determine eligibility.

District must develop a compensatory services plan with the parent by 10/20. If unable to do so, DESE will develop a plan.
