Issue

(1) The special education transportation often picks student up late, causing student to miss class time, and drives off before the monitor has time to fasten student’s seatbelt.

(2) District failed to provide Physical Therapy (PT), Occupational Therapy (OT), and Speech Therapy as required by student’s IEP.

Finding

Noncompliance:

(2) Student missed X therapy sessions, and district already submitted dates for compensatory sessions to be held. Some of the scheduled sessions did not occur so there remained a need for additional sessions.

Compliance:

(1) District provided evidence that they picked up/dropped off student no later than 10 minutes. District is required to provide training for transportation providers regarding student’s special education needs, but not to regulate basic driver safety (which could be addressed through local school committee policy on safety expectations).

Corrective Action

District must submit an updated compensatory services plan by 11/5. If the parent and district are unable to develop a mutually agreed upon plan, they must submit their proposals for DESE to develop a plan.
