Issue

(1) District conducted an IEP meeting without parents’ participation.

(2) District developed and proposed an IEP that did not include parents’ input.

*DESE did not investigate concerns regarding student’s need for a private placement because that matter should be determined via the IEP process.

Finding

Noncompliance:

(1) While the district emailed and called parents, the district did not document multiple efforts to contact the parents regarding a mutually agreeable date for the Team meeting. Also, parents’ unavailability on the proposed Team meeting dates could not be construed as a failure/refusal to participate.

(2) District developed an IEP in a Team meeting without parents’ participation.

Corrective Action

District must send DESE a copy of the IEP Team Notices regarding the reconvening of the Team to finalize student’s IEP by 11/15.

District must send DESE training documentation reviewing requirements for the documenting multiple efforts to contact parents/obtain consent; ensuring parental participation in Team meetings; and data the Team must use to develop IEPs by 11/15.
