Finding

Noncompliance:

Districts cannot require a parent to waive their procedural rights in order to participate in a virtual or remote IEP Team meeting

Corrective Action

District must remove disclaimer language referencing excusal of strict performance of IEP timelines and provide written assurance of statement’s removal.  

District must inform all appropriate staff to discontinue use of language and provide names who received this memo.
