Issue

(1) District failed to include in an N1 the explanation for the reduction in social skills services. The services were not previously included in the IEP, but student had been receiving those services.

(2) District failed to timely provide a copy of the proposed IEP developed in the Team meeting.

Finding

Noncompliance:

(1) District did not explain in an N1 the proposal of social skill services as requested by the parent.

(2) District did not provide the copies of the proposed IEP as requested by the parent in the required timeframe.

Corrective Action

District must issue an N1 explaining the proposed services in the current IEP and send the N1 & documentation of issuance to DESE by 9/17.

DESE ordered no additional corrective action. DESE had already issued corrective action requiring training (9/17) and submitting an implementation monitoring report (12/10) to address requirements for parent response to proposed IEP and placement.
