COMPENSATORY SERVICES

IEP MEETING

Issue

1) District failed to implement reading services and writing instruction as required under the IEP. District asked the parents to waive rights to special education timelines related to implementing the IEP. District maintained that at the beginning of SY20-21, it implemented a stay-put IEP via a hybrid model so that student received X weekly reading and writing services.

2) District did not hold a Team meeting to determine need for compensatory services due to the COVID-19 closure since March 2020.

 

 

Finding

Noncompliance:

1) District did not provide the required reading and writing services for the SY20-21. Although district proposed compensatory services for the missed writing services, there is no evidence that district proposed any reading compensatory services.

 

Compliance:

2) District complied with DESE requirements by considering whether student required Covid Compensatory Services during IEP Team meetings and by monitoring student progress.

Corrective Action

District must submit to DESE the agreed upon proposed compensatory services plan for reading and writing services not provided during the SY 20-21 as well as an assurance letter that the plan will be implemented with fidelity by 11/8/21. If the parties are unable to develop a mutually agreed upon compensatory services plan, they must submit their proposals for DESE to develop a plan.
