Issue

District failed to provide services listed in student’s IEP since student’s enrollment in the district and while pending student’s placement in a public day program.

Finding

Noncompliance:

District acknowledged their failure to provide student’s IEP services and proposed compensatory services for that period when student was without an education program.

Corrective Action

District must develop a plan of compensatory services and obtain agreement with student’s educational decision maker by 11/19. If the parties are unable to develop a mutually agreed upon plan, each party must submit their proposals for DESE to determine a plan.
