Issue

District failed to provide a daily 1:1 nurse as required by student’s IEP.

Finding

Noncompliance:

District acknowledged that the break in nursing resulted from the termination of a nurse due to safety concerns following an incident. Although district was able to secure services from another nurse, student still has not received all of the nursing services required by the IEP.

District is actively seeking a replacement and acknowledges that the Team must discuss staffing challenges, student’s missed services, and a timeline for implementing compensatory services.

Corrective Action

District must send DESE evidence that the Team reconvened and developed a compensatory services plan by 1/7/22. If the parties are unable to develop a mutually agreed upon plan for compensatory services, they must submit their proposals for DESE to develop a plan.
