Issue

District failed to implement student’s IEP because student did not receive the required number of counseling services and consultation services.

Finding

Noncompliance:

District did not provide sufficient make-up counseling to cover all the missed sessions or provide the required consultation services (the special education learning plan [SELP] listed biweekly meetings instead of the weekly meetings required under the IEP—SELP says BCBA would not consult during remote learning, but parent concerned about failure to provide weekly assistive technology consultation).

Corrective Action

District must convene the IEP Team to discuss parent’s concerns regarding assistive technology/ other consultation services and develop a plan to incorporate that consultation information into the IEP. District must send DESE documentation by 10/22.

District must also develop a compensatory services plan with parent by 10/22. If unable to do so, DESE will develop a plan.
