Issue

District did not provide instruction required by IEP during period of remote/hybrid learning

District failed to implement student’s IEP as it permitted a general education teacher to teach special education summer school class.

Finding

Noncompliance:

Although student received related services listed under the IEP, the student did not receive academic services from a special education teacher as required under student’s IEP. District acknowledged the lack of a licensed special education teacher and took corrective action by indicating that it will recruit an additional special education teacher to provide day to day coverage or cover extended leaves. DESE accepts this corrective action but requires additional action.

Corrective Action

District must reconvene the student’s IEP Team to determine what academic regression occurred during the ESY; develop a compensatory services plan with parent by 10/29 (if unable to do so, district and parent must submit their proposals to DESE and DESE will develop a plan); and submit all documentation to DESE by 10/29.
