Issue

(1) District failed to review student’s IEP (expired), did not respond to parent request for a Team meeting, and did not provide notification regarding the delay in convening the IEP team to review the IEP.

Finding

Noncompliance:

(1) District acknowledged it failed to timely provide an Evaluation Consent form (N1A), provide written notice of intent to schedule a Team meeting, and develop a new IEP. District also failed to implement ABA consultant services as required in the IEP.

Corrective Action

By 9/30, District must submit to DESE a signed copy of the agreed-upon compensatory services agreement (if the parties are unable to do so, DESE will develop a plan); a copy of the signed, proposed IEP; and documentation of training for the COSE regarding compliance with IEP timelines.
