Issue

District failed to implement student’s IEP after transferring to a new school in a different district

Finding

Noncompliance:

District failed to implement IEP services “without delay” (delayed more than 30 days). District failed to provide a copy of student’s 2nd IEP for more than 10 days after the annual IEP review.

Corrective Action

District must conduct a training on implementing IEP services without delay in situations of student transfer. Must provide copies of training materials (including name/credentials of the trainer and the attendance roster) to DESE by 9/17.

District must contact complainant and, if interested, develop a signed plan for compensatory services, to DESE by 9/17. DESE will develop a plan if they are unable to develop a mutually acceptable plan.
