COMPENSATORY SERVICES

Issue

(1) District failed to provide direct writing services outside of the classroom for student and other students in the classroom due to lack of a service provider.

(2) District failed to provide inclusion math and writing services in the general education classroom for student and other students. Student had not made effective progress towards IEP goals and in the general curriculum. The IEP Team did not address lack of progress through review and revision of the IEP

(3) Current special education inclusion teacher was previously a paraprofessional and is not licensed in special education and the assigned paraprofessional was not always available in the inclusion classroom as specified in IEP due to staff reassignment

Finding

Noncompliance:

(1) The District did not provide the writing services outside of the classroom as specified in the IEP.

(2) District failed to ensure the implementation of the student’s (and other students’) IEPS in the inclusion classroom (general education teacher affirmed noncompliance). Parents were not informed. District did not consistently provide Parents with the consultation logs, as specified in the IEP.

Compliance: District complied with licensure requirements because the service provider was granted a waiver from DESE.

Corrective Action

District must submit schedule for Compensatory Service Plan or evidence that compensatory services have been provided for this student. District must also send to DESE evidence of consented to compensatory service plans or the implementation of services for the other students in the classroom.

District must conduct training for tracking and monitoring the implementation of students’ IEPs and services (including progress reporting and procedures if a student is missing services). Must send a copy of District’s and school’s procedures and training materials (agenda and attendance). Also, must identify the district personnel responsible for monitoring compliance.

District and school must implement procedures to ensure the student’s parents consistently receive the consultation logs.
