District failed to implement student’s IEP: (1) Specifically, his teacher is not working on “Goal #3.” (2) Additionally, student’s IEP designates a “point person” but District has not identified a specific individual.

* DESE did not investigate complaints from 2019 (occurred more than a year before filing date).

Finding

Noncompliance:

District has not shown that a contact person is consistently available to student. The psychologist has responsibilities to other students and the counselor is only available every other week.

Compliance: District provided documentation showing the implementation of Goal #3.

Corrective Action

District must designate specific staff person(s) as the student’s contact and inform student & parent of these contacts. Evidence of parental communication must be sent to DESE by 9/7.

* DESE suggests mediation if parties are unable to come to an agreement about the context of Goal #3.
