Issue

(1) District delayed conducting the Annual IEP meeting more than 60 days past the scheduled meeting date.

(2) District did not provide a copy of the proposed IEP or summary to family following the Team meeting.

Finding

Noncompliance:

(1) District did not hold the Annual IEP meeting in the required timeframe.

(2) District did not timely provide a copy of the IEP Amendment developed in the meeting (“An IEP provided to a parent within 3-5 days of the Team meeting fulfills the requirement for “immediate” delivery of the IEP to the parent”).

Corrective Action

District Director of Pupil Personnel Services will conduct a training on annual IEP review and parent response to proposed IEPs. The Director will also monitor the Annual IEP Tracking Spreadsheet for monthly compliance.

Documentation of the training must be sent to DESE by 9/24.
