Issue

(1) District failed to administer special education testing within the required timeframe. District acknowledged that testing had not been completed and the Team had not met due to challenges from Covid-19; including staffing shortages, evaluation backlog, increase in evaluations requested, and time constraints. District said they would address in the new school year.

Finding

Noncompliance:

District did not conduct the evaluations within 30 school working days or convene a Team meeting within 45 school days of parent’s consent for an evaluation.

Corrective Action

District must conduct the requested evaluations and hold a Team meeting prior to the start of school on 9/3.

Documentation and a copy of the proposed IEP must be sent to DESE by 9/17.
