Issue

(1) District failed to timely conduct 3-year reevaluations and provide copies of the evaluations to the parent prior to the Team meeting.

(2) District did not timely provide a copy of the proposed IEP following the Team meeting. Parent had previously filed a complaint for district’s failure to timely provide a copy of the proposed IEP. DESE ordered corrective action for district’s noncompliance with requirements for providing copies of IEPs. District completed the corrective action by conducting a training to address the violation and to ensure the timely provision of IEPs moving forward.

Finding

Noncompliance:

(1) District did not conduct evaluations within 30 school working days or hold a Team meeting within 45 school days of the parent’s consent for evaluation.

(2) For the second time, district failed to immediately provide parent 2 copies of the proposed IEP.

Corrective Action

District must repeat the training conducted on timely delivery of this student’s IEP. The new training should also include all members of the student’s IEP Team. A signed attendance roster with attendees’ name, position, and role must be submitted to DESE by 9/17.

In addition, because of previous noncompliance found on the same issue, District must submit (only to DESE) results of an internal review report of timely provision of 10 IEPs by 12/10. District must identify any ongoing noncompliance and the corrective actions taken.
