Issue

(1) District refused to allow parents to audio record Team meetings.

(2) District failed to provide parents with a “draft IEP” after an IEP reconvene meeting.

(3) District failed to provide parents and advocate with a requested copy of the student’s academic record.

Finding

N/A:

(1) Special education statutes & regulations don’t address the use of audio or video recording devices so district has the option to require, prohibit, or limit use of recording devices at IEP meetings.

(2) District is not required to provide a draft but may provide a summary.

Noncompliance:

(3) District has yet to fully respond to the request for student’s entire records. There was no unauthorized 3rd party access of the records because of the release/exchange of information consent on file.
