Issue

(1) District did not conduct additional requested assessments nor send a N-2 explaining refusal and failed to identify all requested assessments not conducted in N-1 and why.

(2) Failed to respond promptly to an Independent Educational Evaluation request.

(3) Refused to discuss student’s need for an ESY program.

(4) Failed to notify BSEA of their partial rejection of the proposed IEP.

(6) Failed to provide small group instruction per IEP requirements.

(7) IEP Team did not consider whether student could be a possible aggressor/target of bullying.

Finding

Noncompliance:

(1) District did not provide parent an opportunity to consult about the proposed evaluation, did not indicate plans to complete the additional assessments when student returned to in-school learning, nor provide notice.

(4) District acknowledged notice was sent late due to Covid and took corrective action.

Compliance:

(3) IEP Team sent an amendment including extended year services.

(7) Parent brought up discussion of bullying at the Team meeting.

Corrective Action

District must:

(1) complete any remaining assessments or issue an N-2 explaining reason for refusal. Send to DESE by 9/20/21;

(2) Send a description of the remote monitoring system for BSEA notification to DESE by 9/20/21;

(3) Review with Team chairpersons the requirements to offer parents the opportunity to discuss the evaluation proposal, to provide notice if District refuses to act, and to include in the N-1 the rejected options that were considered and why they were rejected. The name and title of the presenter and of attendees must be sent to DESE by 9/20/21;

(4) Send DESE any follow-up materials regarding the district’s response to the parent’s request for an independent education evaluation.
