Issue

(1) District did not provide the full IEP and notice following the Team meeting.

(2) District violated state discipline regulations and did not follow due process when it did not consider student’s removal for violation of COVID safety protocols from school to remote learning a suspension.

Finding

Noncompliance:

(1) Team meeting summary did not include goals agreed upon; Parent was not asked if provision of the summary was acceptable nor explained the timing implications for receipt of the full IEP.

(2) District failed to follow its own policy stating noncompliance with COVID safety protocols, should be communicated to parents in an administrative disciplinary meeting prior to removal from in person learning and with written documentation of noncompliance and efforts toward compliance.

Corrective Action

(1) Provide family with N1 for IEP including the options proposed and rejected by 8/1/21 (and to DESE by 8/30/21).

(2) Submit a revised “Annual IEP Meeting Procedure for Scheduling and Follow-up” and District IEP Team Meeting Summary Template by 8/30/21.

(3) Execute requirements outlined in District’s policy related to discipline during Covid-19 for this student and submit individual documentation by 8/30/21.

(4) Develop and submit a plan (include agenda, training materials, and staff dissemination) to prevent reoccurrences of violations of District Discipline Policy by 8/30/21.
